Briant VPN Add-On Terms

1. About these VPN Add-On Terms

These VPN Add-On Terms apply when you purchase, activate or use the Briant VPN add-on service (the “VPN Service”).

These terms form part of your agreement with Briant Broadband Limited (“Briant”, “we”, “us” or “our”) and should be read together with our main terms and conditions, Acceptable Use Policy, Privacy Policy, Charges Schedule and any Contract Information or Contract Summary provided to you before purchase.

If there is any conflict between these VPN Add-On Terms and our main terms and conditions, these VPN Add-On Terms will apply only in relation to the VPN Service, unless stated otherwise.

2. What the VPN Service is

The VPN Service is an optional add-on service designed to help improve online privacy and security by encrypting certain internet traffic between your device and a VPN server.

The VPN Service may include VPN software, applications, extensions, servers, IP addresses, protocols and related technical components made available through Briant or a VPN technology supplier.

The VPN Service is not antivirus software, a managed cybersecurity service, fraud protection, parental-control software, cyber insurance, legal advice, business compliance support or a guarantee against online harm.

3. Key limitations

You acknowledge and agree that the VPN Service may reduce your internet speed and that performance may vary depending on your device, location, Wi-Fi environment, selected server, internet connection, third-party networks and general internet conditions.

The VPN Service does not guarantee anonymity, uninterrupted availability, access to any specific website, app, streaming service, online platform, country, region, server, IP address or online content.

Some websites, apps, streaming services, banking services, gaming services, payment services or other third-party services may block, restrict, challenge or treat VPN traffic differently.

The VPN Service does not make unlawful activity lawful and must not be used to avoid legal obligations, contractual restrictions, sanctions, age restrictions, location restrictions or platform rules.

4. Eligibility, account and password responsibility

You must be at least 18 years old to purchase or use the VPN Service.

You are responsible for all use of the VPN Service through your account, including use by household members, employees, guests, contractors or anyone else who accesses the service using your credentials or devices.

You must keep your login details secure. You must not sell, transfer, share, sublicense, resell or make the VPN Service available to anyone outside your household or business unless we have agreed this in writing.

You must notify us promptly if you suspect unauthorised use of your account, email address, password or VPN access credentials.

5. Business customers

If you purchase the VPN Service as a business customer, you confirm that you are authorised to enter into these VPN Add-On Terms on behalf of the business.

The business is responsible for all use of the VPN Service by its users, staff, contractors and authorised representatives.

Unless expressly agreed in writing, the VPN Service is not provided as a managed security service, managed IT service or business compliance solution.

6. Devices and fair usage

You may use the VPN Service on your own personal or business devices, subject to fair usage, technical limits and any simultaneous connection limits notified to you.

We may apply, change or enforce reasonable fair-usage controls where use is excessive, harmful, abusive, commercially exploitative, likely to degrade the service for other users, or inconsistent with normal residential or business use.

You must not resell, commercially exploit or provide the VPN Service as a service to third parties without Briant’s written permission.

7. Charges, billing and renewal

The price of the VPN Service will be the price shown to you by Briant at the point of order and in your order confirmation.

Unless stated otherwise in your order, the VPN Service is provided as a recurring monthly add-on and will continue until cancelled in accordance with these terms.

If the VPN Service is included in a bundle, promotion or fixed-term agreement, the minimum term, renewal terms, cancellation rights and any early termination charges will be set out in your Contract Information, Contract Summary, order confirmation or other pre-contract information provided to you.

Any future in-contract price increase will be communicated in a way required by applicable law and regulation. Where required, any such increase will be shown upfront in pounds and pence and will not be described only by reference to inflation or a percentage increase.

8. Cancellation and refunds

If you are a consumer and you purchase the VPN Service online, by phone or away from our premises, you may have a 14-day cancellation right from the date the contract is made, unless an exception applies.

If you ask us to activate the VPN Service during the 14-day cancellation period, you acknowledge that we may begin providing the service immediately. If you cancel after activation, we may charge you for the service provided up to the point of cancellation where the law allows us to do so.

If the VPN Service includes digital content or app access that is made available immediately, we may ask you to acknowledge that immediate access may affect your cancellation rights where applicable.

VPN Service charges are non-refundable except where required by law, where we have failed to provide the service with reasonable care and skill, or where your statutory rights apply.

Nothing in these terms affects your statutory rights.

9. Lawful and acceptable use

You must use the VPN Service lawfully, responsibly and in accordance with all applicable laws and regulations in the United Kingdom and in any country from which you access or use the VPN Service.

You are solely responsible for ensuring that your use of the VPN Service is lawful in your location and in any location to which your traffic is routed.

You must comply with the Briant VPN Acceptable Use Policy published with these terms.

10. Suspension and termination

We may suspend, restrict or terminate the VPN Service immediately if you breach these terms, breach the Briant VPN Acceptable Use Policy, fail to pay charges due, or if we reasonably suspect unlawful, abusive, fraudulent, harmful or security-risk use.

We may also suspend, restrict or terminate the VPN Service if continued provision creates a security, operational, legal, regulatory, supplier or reputational risk, or if our VPN technology supplier suspends, withdraws or materially changes the underlying platform.

Where reasonably possible, we will notify you before suspension. However, we may act without prior notice where urgent action is needed to protect Briant, our customers, our suppliers, our network, third parties or the public.

11. Changes to the VPN Service or these terms

We may update, change, replace, suspend or withdraw features, servers, locations, protocols, apps or technical components of the VPN Service from time to time.

If we make a change that materially disadvantages you, we will give you reasonable notice where required by law or regulation and explain your options, including any right to cancel where applicable.

We may make urgent changes without prior notice where needed for security, legal, regulatory, supplier, operational or network-integrity reasons.

12. Third-party VPN technology platform

The VPN Service may be delivered using a third-party VPN technology platform, software, applications, hosting, servers, networks, infrastructure, support services or other technical components.

Briant does not need to disclose the identity of the underlying VPN technology supplier unless required by law, regulation, data-protection transparency obligations, contract or lawful authority request.

We remain responsible for providing you with clear customer-facing information about the VPN Service, charges, key limitations, privacy implications and your customer rights.

The operation of the VPN Service may depend on third-party systems and networks outside our direct control.

13. Privacy and logging

Our use of personal data in connection with the VPN Service is explained in the Briant VPN Privacy & Logging Notice published with these terms.

We do not sell your personal data.

We do not intentionally monitor the content of your internet browsing through the VPN Service.

However, we and/or our VPN technology supplier may process limited account, billing, support, device, diagnostic, security, operational and connection-related data where necessary to provide, secure, support, bill, improve and protect the VPN Service, comply with law, respond to lawful requests, prevent abuse and enforce our terms.

14. Legal and regulatory requests

We may preserve or disclose information where required or permitted by law, regulation, court order, lawful authority request or other legal process.

We may also preserve or disclose information where we reasonably believe this is necessary to protect Briant, our customers, our suppliers, our network, third parties, the public, or to investigate or prevent unlawful, harmful or abusive activity.

15. Security limitations

You are responsible for keeping your devices, operating systems, browsers, apps, passwords and security software up to date.

The VPN Service does not protect you from all cyber risks, including phishing, malware, unsafe downloads, compromised devices, social engineering, insecure websites, weak passwords, scams or your own disclosure of personal information.

We do not guarantee that the VPN Service will prevent all tracking, interception, cyber attack, fraud, data loss or unauthorised access.

16. Support

We will provide reasonable support for activation and general use of the VPN Service.

Unless expressly agreed in writing, we do not provide managed IT support, device repair, cybersecurity incident response, forensic investigation, business compliance support or configuration of third-party systems.

17. Liability

Nothing in these terms excludes or limits our liability where it would be unlawful to do so, including liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, or your statutory rights as a consumer.

Subject to the above, we are not responsible for loss caused by your misuse of the VPN Service, unlawful activity, failure to secure your devices or credentials, loss of access to third-party websites or platforms, reduced speeds or performance variations, third-party blocking or filtering, or indirect, consequential or unforeseeable losses.

For business customers, subject to the exclusions that cannot lawfully be excluded, our total aggregate liability arising out of or in connection with the VPN Service shall not exceed the total VPN Service charges paid by you in the 12 months preceding the event giving rise to the claim. For business customers, we shall not be liable for loss of profit, loss of revenue, loss of business, loss of goodwill, loss of data, loss of anticipated savings, business interruption, indirect loss or consequential loss.

18. Business customer indemnity

If you are a business customer, you agree to indemnify Briant against losses, claims, damages, penalties, costs and expenses arising from unlawful, abusive or prohibited use of the VPN Service by you or your users, breach of these terms or the Briant VPN Acceptable Use Policy, infringement of third-party rights, or claims and investigations arising from your use of the VPN Service.

19. Governing law

These VPN Add-On Terms are governed by the laws of England and Wales.

If you are a consumer, you may bring proceedings in the courts of England and Wales, or in the courts of the part of the United Kingdom where you live. Nothing in these terms affects any mandatory consumer protection rights you may have under the law of the part of the United Kingdom where you live.

If you are a business customer, the courts of England and Wales shall have exclusive jurisdiction.
